WR motormen allege conspiracy against them -The Free Press Journal page 7  Dated  9.12.11

RADHIKA GANGADHAR Mumbai

The Western Railway Motormen’s Association ( WRMA), in a letter addressed to the divisional railway manager of Western Railway ( WR), has alleged a conspiracy brewing against the motormen and the administration by stating ” criminal/ terrorist activities are being schemed against them with the help of some train technical experts”. Dated December 8 ( Friday), the letter said that the recent technical snags experienced by motormen plying trains on the western suburban railway were being planted by certain anti- social elements whose deliberate aim is to cause a train accident in Mumbai and harm the commuting public in the long run.

” Recently, on trial basis, an attempt to cause a train accident was made on November 30 by making the brake ineffective at Vile Parle station. But motorman Shivakumar S, being experienced, vigilant and highly alert, sensed that something was wrong and applied the emergency brakes to thwart the accident.

After a long detention, the tampering was attended to by a group of train examiners and they found that, in this criminal conspiracy, someone had switched on the DCS key in the first motor coach of the train, resulting in brake failure when it was running at full speed,” P N Gupta, general secretary of WRMA said in the letter on Friday.

Quoting another instance, Gupta said, ” A few days ago, a railway employee saw a young boy and girl open the motor coach of a train stationed at Mumbai Central using a key that is exclusively meant for motormen or train examiners only.

Although this was immediately reported to the EMU control room, it is not yet known as to what action, if any, was taken in that regard.” The association has requested the railway administration to make necessary arrangements to lock motor coaches to stop intruders from entering and carrying out any such activities that may endanger passengers’ safety, the railways or even the motormen.

Bangalore CATS judgement on weekly rest of driving staff

October 26, 2011

Throughout India the system that is being followed is that after six days 30 hours off is given to driving staff. If 30 hours of rest is given it means that either they have to either sign on everyday or sign of everyday. Which means that you work each and every day, all 365 days of year and is still there is an illusion that they are getting weekly off.

In those 30 hours, you were already entitled for 16 hours home rest so the administration was giving you only 14 hours extra.

I have seen the railway unions for the last 19 years and found that so many compromises are being made by them, and the driving staff is being deprived of several amenities and facilities that the honourable President of India has granted for them. All this happens with help from recognised unions.

When I requested for mileage forms (as claimed by him) of one particular union leader I found that he was getting 13 to 17 special casual leaves every month. so they are unlikely to take any real steps for the welfare of the driving staff, and they themselves will have to take the matter is in their hands rather than to wait for the unions to do something for them

They get the facilities like these for suppressing the driving staff.

Since these things are being done for years together as a result  many of the diving staff themselves have developed a feeling, that the unions are very powerful ( as they themselves claim ) and nothing can be done without their support.

The honourable Bangalore CAT has given the judgment that the weekly off for the driving staff should be 30 hours (weekly rest) +16 hours (home rest) =46 hours at the minimum. Both the weekly rest and home rest are different things and both of them have to be given. In case due to shortage of staff, this rest is breached then Railways must pay wages at twice the normal rate for each hour breached.

The railway Administration also says that it is because of the loss in mileage the driving staff does not want to take longer weekly offs. Regarding this the honourable cat has said that even if the driving staff wants to work overtime with less rest  it is the duty of the railway Administration to give it full rest to them.

Please mind you that it will not be easy, and you may have to get a corresponding order from the CAT in your area.

I am here by attaching the order of the court that is honourable CAT of Bangalore.
